Gov.-elect Andrew M. Cuomo said Monday that his running mate, incoming Lt. Gov. Robert J. Duffy, has the legal power to break a leadership tie between Republicans and Democrats if the current recounts result in a 31-31 split in the State Senate.

"The lieutenant governor would be a tiebreaking vote in leadership selection, if it came to that," Cuomo said. "But let's count the vote first. Let's find out who won, and then we'll figure out a strategy to deal with it."
